Boba · Terms
The short version
Boba is a voice-first AI friend and teacher for kids. Only a parent or legal guardian can create an account, and the parent is responsible for what happens in the child's account.
Boba uses third-party AI providers (OpenAI, ElevenLabs and others). AI output is generated, not authored, so it can occasionally be wrong. We do our best to keep it safe and accurate, but you should treat Boba as a learning companion, not a replacement for a teacher, doctor, or therapist.
You can cancel and delete your account anytime. Be kind to Boba.
These Terms of Service ("Terms") form a binding agreement between you and Boba ("we", "us", "our") and govern your access to and use of the Boba website, the Boba mobile and tablet app, and any related services (together, the "Service"). By creating an account, joining the waitlist, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
These Terms incorporate our Privacy Policy.
The Service is intended for use by children under the supervision of a parent or legal guardian. To create an account or join the waitlist, you must be at least 18 years old and the parent or legal guardian of the child who will use Boba.
If you allow a child under 13 to use Boba, you confirm that you have given verifiable parental consent through the in-app consent flow, that you understand how Boba works, and that you will supervise your child's use as you see fit.
You are responsible for any activity that takes place under your account, including activity by your child or anyone else you allow to use the Service.
To use the full Service you'll create an account with an email address and password. Keep your credentials private. Tell us promptly if you suspect unauthorized access at hello@boba.app. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used to harm Boba or other users.
When you use Boba, you agree not to:
We may remove content or restrict access if we reasonably believe these rules have been broken.
Boba's responses are generated by large language models and synthesized voices provided by third parties (currently OpenAI for language and ElevenLabs for voice; the full and current list lives in our Privacy Policy). AI-generated output can occasionally be wrong, incomplete, or unexpected. Treat Boba as a friendly learning companion, not as a substitute for professional advice, instruction, medical care, or therapy.
You agree not to rely on Boba for decisions that require certified expertise (for example, medical, legal, financial, mental-health, or safety-critical decisions). If your child's question or behavior raises a serious concern, please consult a qualified professional.
We continuously refine Boba's safety and pedagogy layers, and we welcome reports of any reply that feels off (hello@boba.app).
Some features of Boba may require a paid subscription, processed through Apple's in-app purchase system. If you subscribe:
You can cancel a subscription anytime in your Apple account settings. You can delete your account anytime from inside the app (Settings → Delete account) or by emailing privacy@boba.app. Deletion is permanent; we will remove your account and associated child profiles, transcripts, and memory within 30 days, subject to limited legal-record obligations.
Boba, the Boba mascot, the wordmark, and all related design, software, and content are owned by us or our licensors. We grant you a limited, personal, non-transferable, non-exclusive license to use the Service for your family's personal, non-commercial use, subject to these Terms.
You retain ownership of any content you provide. By providing content (for example, your child's name, profile info, or feedback), you grant us a non-exclusive license to use it to operate, maintain, and improve the Service for that account.
Our handling of personal information is described in our Privacy Policy, which forms part of these Terms.
The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and that the Service will be uninterrupted or error-free.
Boba is not a medical, mental-health, or educational accreditation provider. Nothing in the Service constitutes professional advice. You are solely responsible for decisions you make based on Boba's output.
To the fullest extent permitted by law, Boba and its officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, goodwill, or other intangible losses, arising out of or in connection with the Service.
Our total cumulative liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amounts you paid us in the 12 months before the event giving rise to liability, or (b) USD $50.
Some jurisdictions do not allow the exclusion of certain warranties or limitation of certain damages; in those jurisdictions, the above applies to the maximum extent permitted by law.
You agree to defend, indemnify, and hold us harmless from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising out of (a) your breach of these Terms, (b) your misuse of the Service, or (c) your violation of any law or third-party right.
You can stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if your account is being used in a way that creates legal or security risk, or if we discontinue the Service. We will give reasonable notice where we can. Sections that by their nature should survive termination (for example, intellectual property, disclaimers, limits on liability) will continue to apply.
We may update these Terms from time to time. If a change is material, we will tell you by email or in-app notice at least 14 days before it takes effect. The "Last updated" date at the top of this page always reflects the current version. Continued use after the change takes effect means you accept the new Terms.
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-laws principles. To the extent permitted by law, you and Boba agree that any dispute will be resolved in the state or federal courts located in Delaware. Nothing in this section limits any non-waivable rights you have under the law of your country of residence.
